Alternative Dispute Resolution

Alternative Dispute Resolution (ADR) is the process of resolving legal conflicts without going to trial. We have substantial training in arbitration and mediation. We counsel clients in determining when ADR is in their best interests and meets their needs better than traditional litigation, and on the legal consequences flowing from the use of each ADR option.

Business and Commercial Law

We provide a wide variety of services to our business clients from assisting in selecting the type of organizational entity under which to operate, preparation of agreements, sale and purchase of businesses, obtaining financing and funding for business operations, and employee relations, to dissolution.

Debtor/Creditor

We will pursue a variety of remedies to facilitate all types of creditors in obtaining collection of their just debts. This includes representation of individual and commercial creditors in bankruptcy proceedings, at both the state and federal level, in facilitating their rights to recover their just share of the debtor's remaining assets. We will also represent individuals and commercial clients in bankruptcy proceedings, at both the state and federal level, that are initiated by either an insolvent individual or business, or creditors seeking to have the debtor's remaining assets distributed among the creditors. Bankruptcy proceedings can involve either restructuring and reorganizing insolvent persons' debt structure, or discharging them outright from any further obligations on their debts.

Family Law

Our firm handles a full range of Family Law matters, including adoption, premarital agreements, contested and uncontested divorce, legal separation, establishment and modification of child support, establishment and modification of child custody and visitation, cohabitation and domestic partnership documents, and paternity.

Landlord/Tenant Law

A variety of disputes frequently arise between the fee owner of a commercial or residential property and persons who rent from the owner the temporary right to possess and occupy the property. Our firm will negotiate resolutions to these disputes, and litigate them if necessary.

Probate & Estate Administration

We handle probate and estate administration. Probate is the legal process by which a will is proved to be valid and decedents' debts are paid and assets distributed after they die. Estate administration includes the probate process as well as non-probate transfers of the deceased's assets, and generally includes collecting all of the decedent's assets, liquidating his or her liabilities, paying necessary taxes (if any), and distributing property to heirs. State laws direct the probate court how to distribute the deceased's estate, so it is important to consult a firm for representation in this area of the law.

We will represent both commercial clients and individuals in all proceedings and transactions that deal with real property-land and the structures attached to it-including purchase and sale agreements, construction, mortgages, foreclosures, leases, zoning, title examinations, quiet title actions, closings, and property management.

A Cum-Laude graduate of Texas Wesleyan University School of Law with a Juris Doctor degree. Diane Heindel also has a degree from Dallas Baptist University and completed Management Skills for Women in Business from the Edwin L. Cox School of Business at Southern Methodist University.

She is accredited to practice in all Texas Courts as well as the United States Supreme Court. A member of the State Bar of Texas, The Collaborative Law Institute of Texas and Smith County Bar Association, she is also a graduate of the National Mediation Academy in Dallas. Mrs. Heindel is certified as a Mediator and Neutral and an Attorney Ad Litem by the State Bar of Texas.
